What kind of Foundation is the SMCCCD? Can they legally contribute to a Committee formed to support the SMCCCD Bond Measure? According to minutes of the Foundation meetings, SMCCCD Trustees are included on that committee.
Does the fact that their $20,000 contribution (or Grant) was made on 5/12/99, prior to the SMCCCD Board vote to place the Bond Measure on the Ballot, make it OK?
It was revealed to this writer, that on July 20, 1999, the Foundation for SMCCCD Board of Directors authorized another $20,000 contribution to the Bond campaign!
At the meeting on March 16, the Board approved its first $20,000 grant. Following is an excerpt from the minutes of that meeting:
"CSM President Landsberger read a letter from Chancellor Johnson asking for the Foundation's support in mounting the bond campaign. He asked the Foundation to contribute $40,000 to that campaign. Speaking in support of his letter were District Board members Karen Schwarz, Patricia Miljanich, Tom Constantino, and Helen Hausman. Executive Director Patnode noted that this action was not his recommendation and commented on legal, financial, strategic, and other aspects of the grant."
Note: SMCCCD Board members Constantino and Hausman also serve on the Foundation Board.
Why are these Board Members risking the tax-exempt status of an organization which has here-to-fore supported District Programs, and provided scholarships to deserving students? In accepting these funds, do the Citizens for Higher Education become co-conspirators in this scam?
Quite possibly, these actions, when placed in the context of other District activities (see SMCCCD-PR or Felony?), fall under the Rico Act. Perhaps some resignations are in order.
As a trustee of the District, I would vigorously oppose any attempts to redirect Foundation funds to political purposes.
